The High Court in Suva has mandated the eviction of squatters from a tract of land in Tacirua East owned by Ridgeview Estate Pte Ltd. The company’s director, Anthony Eugene Ah Koy, submitted an affidavit to the court asserting that the individuals occupying the land without permission have no rights to remain.
In court proceedings, it was revealed that the squatters’ identities and personal details were largely unknown, making it challenging for the company to serve them notices. Some squatters acknowledged Ridgeview Estate Pte Ltd’s ownership of the land, which has been in effect since 2017, but claimed their occupation of the land began before the property was granted to the company and alleged that they had not been properly informed of the land’s transfer.
Justice Savenaca Banuve ruled in favor of Ridgeview Estate Pte Ltd, instructing the squatters to vacate the premises. He emphasized that the Sheriff of the Court, along with police assistance, should oversee the removal and ensure that all illegally connected utilities, such as electricity and water lines, are safely disconnected and dismantled.
This ruling underscores the importance of property rights and legal ownership, ensuring that such matters are addressed through the judicial system. While the decision may pose immediate challenges for the affected individuals, it also highlights the importance of clear communication and legal processes in property disputes. As a result, it may encourage better dialogue between landowners and communities in similar situations moving forward.
In summary, the High Court’s decision reflects its commitment to uphold legal property rights while presenting an opportunity for improved communication and resolution strategies for future land use concerns.
