The High Court in Suva has scheduled a hearing for the strike out application filed by former Director of Public Prosecutions, Neelraj Sharma. This application is tied to a significant compensation claim of $800,244 made by Veronica Malani against eleven individuals who participated in the investigation of the alleged 1987 bombing case in 2020.
During the court proceedings on Wednesday, Justice Usaia Ratuvili presided over the case, with all lawyers in attendance. Sharma’s attorney, Ronal Singh, informed the court that they were prepared to set a hearing date. Meanwhile, Malani was granted additional time to ensure her attorney, Sitiveni Raikanikoda, could be present.
The hearing is set for December 11, with all parties expected to submit their documents before that date. Raikanikoda also raised concerns regarding the defense’s adherence to civil procedure, expressing that none of the defense attorneys had filed a statement of defense following the issuance of the writ of summons, opting instead to file a strike out application immediately.
Additionally, he questioned the representation of retired government officials Rusiate Tudravu and Biu Matavou, noting they were represented by the Office of the Attorney-General despite being retired. Justice Ratuvili affirmed that the trial would proceed regardless of the appearances of these defendants.
This case highlights the complexities involved in legal proceedings, especially regarding compensation claims tied to historical events.
