The High Court in Suva has scheduled a hearing for the strike out application filed by Neelraj Sharma, the former Director of Public Prosecutions. This application pertains to compensation claims amounting to $800,244 made by Veronica Malani against 11 individuals involved in the investigation of the alleged 1987 bombing incident in 2020.
All legal representatives were present in court before Justice Usaia Ratuvili on Wednesday. During this session, Sharma’s lawyer, Ronal Singh, expressed readiness to set a hearing date. However, Malani was granted additional time to ensure her attorney, Sitiveni Raikanikoda, could also attend court.
Justice Ratuvili set the hearing for December 11, allowing all parties to prepare their submissions before that date. In his arguments, Mr. Raikanikoda raised concerns about the defense’s failure to adhere to proper civil procedure. He noted that none of the defense attorneys had filed a statement of defense following the issuance of the writ of summons and instead moved straight to filing a strike out application.
Additionally, he questioned the representation of the fifth and sixth defendants, former acting Police Commissioner Rusiate Tudravu and retired ACP Crime Biu Matavou, both represented by the Office of the Attorney-General. He inquired whether these retired officials should also secure legal representation given their involvement in the lawsuit. Justice Ratuvili indicated that, regardless of their representation, the trial would proceed as scheduled.
This case reflects the complexity of legal processes involving high-profile accusations and the importance of following procedural protocols in court. The upcoming hearing offers a chance for clarity and resolution in a matter that has drawn public interest due to its historical significance.
