High Court Sets Date for Controversial Compensation Claims Hearing

The High Court in Suva has scheduled a hearing for the strike out application submitted by former Director of Public Prosecutions, Neelraj Sharma. This application pertains to the substantial compensation claims of $800,244 made by Veronica Malani against 11 individuals involved in the investigation of the alleged bombing case from 1987.

All legal representatives were present before Justice Usaia Ratuvili during the session on Wednesday. Sharma’s attorney, Ronal Singh, indicated that they were prepared to proceed with the hearing. However, the court granted additional time for Malani to ensure her attorney, Sitiveni Raikanikoda, could attend.

Justice Ratuvili has set the hearing for December 11, urging all parties to submit their arguments prior to this date. Mr. Raikanikoda also raised concerns regarding the defense’s adherence to civil procedure protocols, pointing out that none of the defense lawyers filed a statement of defense after receiving the writ of summons, opting instead to file a strike out application.

Furthermore, he questioned the representation of retired officials Rusiate Tudravu and Biu Matavou, who are among the defendants in this case, noting they were represented by the Office of the Attorney-General despite being retired civil servants. Justice Ratuvili responded that the trial would proceed irrespective of their presence at this stage.
