High Court Set to Hear High-Profile Legal Drama in $800K Compensation Case

The High Court in Suva has scheduled a hearing date regarding a motion from Neelraj Sharma, the former Director of Public Prosecutions. This motion pertains to compensation claims amounting to $800,244 made by Veronica Malani against eleven individuals involved in the investigation of a former bombing case from 1987.

During the court proceedings held on Wednesday, all attorneys were present before Justice Usaia Ratuvili. Neelraj Sharma’s attorney, Ronal Singh, indicated that they were prepared to proceed with scheduling a hearing. However, Veronica Malani was granted additional time to ensure that her attorney, Sitiveni Raikanikoda, could also be present in court.

Consequently, Justice Ratuvili set the hearing for December 11, giving all involved parties the opportunity to submit their arguments before that date. Mr. Raikanikoda raised concerns regarding the defense’s adherence to civil procedure rules, noting that none of the defense attorneys had filed a statement of defense after receiving the writ of summons. Instead, they chose to directly file a motion to strike out the claims.

Raikanikoda also questioned the representation of two retired police officials, Rusiate Tudravu and Biu Matavou, who are listed as the fifth and sixth defendants. He pointed out that although these individuals were retired public servants, they were being represented by the Office of the Attorney-General. He queried whether they needed independent legal representation and whether they should submit their own filings, as they were part of the ongoing lawsuit. Justice Ratuvili stated that the trial will continue regardless of their appearance at this stage.

This legal case highlights complex issues within the justice system and procedural adherence, reflecting the need for clarity in the representation of defendants, especially retired officials involved in significant historical cases.
