The High Court in Suva has scheduled a hearing for former Director of Public Prosecutions Neelraj Sharma’s application to strike out compensation claims amounting to $800,244 million. These claims were filed by Veronica Malani against 11 individuals involved in the investigation of a 1987 bombing case dating back to 2020.
During the court proceedings held on Wednesday, all attorneys were present before Justice Usaia Ratuvili. Sharma’s lawyer, Ronal Singh, indicated their readiness to proceed with a hearing date. However, Malani was granted additional time to ensure her own lawyer, Sitiveni Raikanikoda, could attend.
Justice Ratuvili has set the hearing for December 11, by which date all parties are to submit their arguments. Notably, Raikanikoda raised concerns regarding the defense team’s approach, as they had not adhered to appropriate civil procedure. He pointed out that the defense did not file a statement of defense after receiving the writ of summons, opting instead to immediately file a strike out application.
Additionally, Raikanikoda questioned the representation of retired officers Rusiate Tudravu, a former acting Police Commissioner, and Biu Matavou, a retired Assistant Police Commissioner, both of whom are among the defendants. He expressed uncertainty over whether they, being retired government employees, should obtain their own legal representation and submit their defenses in light of the ongoing lawsuit. Justice Ratuvili responded that the trial would proceed regardless of their appearance.
