High Court Ruling Forces Squatters to Evacuate Fiji Land

The High Court in Suva has ruled for the removal of squatters from land in Tacirua East, owned by Ridgeview Estate Pte Ltd. The company’s director, Anthony Eugene Ah Koy, presented an affidavit stating that the squatters occupying the property on Khalsa Rd had no legal right to do so. The court was informed that assisting the squatters was challenging due to the lack of information about their identities, locations, and occupations.

Some squatters acknowledged Ridgeview Estate Pte Ltd’s ownership since 2017 but argued that their occupation predates the lease agreements, claiming they had the landowning mataqali’s approval. They also stated they were not informed when the land ownership was transferred to Ridgeview Estate Pte Ltd.

Justice Savenaca Banuve ruled in favor of Ridgeview Estate Pte Ltd, instructing that the squatters vacate the premises. The order required the Sheriff of the Court and/or their officers to physically remove the squatters and their belongings, including any illegally connected utilities like water and electricity. The Sheriff was also directed to coordinate with police to ensure the removal process was conducted safely.

This ruling highlights the ongoing challenges of land ownership and squatter settlements in Fiji. It serves as a reminder of the complexities surrounding informal settlements, where individuals often face difficult circumstances yet must navigate legal frameworks to assert their rights.
