The High Court has instructed the magistrate responsible for handling the case of Waisea Naitini, a 30-year-old man who unlawfully entered the Prime Minister’s compound, to allow him to plead not guilty. Justice Daniel Goundar issued this directive following a review of procedural irregularities in Naitini’s previous guilty plea, which had been accepted by the magistrate without sufficient examination of the facts.

During the review, Justice Goundar expressed serious concerns regarding the magistrate’s failure to thoroughly assess the voluntariness of Naitini’s guilty plea. He pointed out that the plea, accepted without a full inquiry into the charge’s specifics, was misleading as it appeared to be based on a duplicitous charge that incorrectly merged separate legal provisions.

Justice Goundar noted that the charge did not properly align with the laws under Section 387 (c) of the Crimes Act, ultimately leading to confusion about the true nature of the allegations against Naitini. He vacated the guilty plea, emphasizing that without a proper examination of the facts, it was impossible to determine the charge’s legitimacy or to consider the magistrate’s prior inclination towards promoting reconciliation rather than following through with appropriate sentencing.

As a result of the ruling, the case is set to proceed to trial unless the Director of Public Prosecutions decides otherwise, with Naitini currently released on bail. This decision reflects a judicial commitment to ensuring fairness and due process in the legal system.

The case draws attention to the importance of procedural diligence in the courts and highlights broader issues related to accountability and security protocols at governmental facilities, reinforcing the notion that all individuals, regardless of circumstances, are entitled to a fair trial.
