The High Court in Lautoka, presided over by Justice Aruna Aluthge, has authorized the destruction of a batch of seized methamphetamine, which is part of an ongoing legal case involving Justin Ho and nine others charged with the importation of over 4.2 tons of the drug. The illicit drugs, valued at an estimated $2 billion, are to be disposed of in accordance with an application from the Office of the Director of Public Prosecutions (ODPP) under the Illicit Drugs Control Act 2004.

On Friday, Justice Aluthge outlined several key directives regarding the disposal process:
1. A police officer not lower than the rank of Assistant Superintendent must oversee the destruction, which can occur through incineration or other safe methods.
2. Prior to the destruction, a two-week notice must be given to the Court and all relevant parties, detailing the date, location, and method of destruction.
3. Subject to security measures, the legal representatives of the defendants may be allowed to observe the disposal.
4. The destruction process must be documented through photographs and, preferably, video recordings.
5. To uphold transparency, the ODPP may invite the local Resident Magistrate to witness the destruction.
6. A comprehensive report confirming the disposal will be prepared by the responsible officer and two witnesses, detailing that the destruction was conducted in compliance with the court order.
7. This report must be filed with the Court within two weeks following the destruction.

This ruling marks a significant step in ensuring the integrity of the judicial process concerning illicit drug enforcement in Fiji, emphasizing accountability and transparency in handling such serious criminal matters. As the justice system tackles drug-related crimes persistently, the actions taken by the court serve as a strong deterrent against drug trafficking.

In summary, the court’s decision to destroy the seized methamphetamine reflects a crucial effort to maintain the rule of law and public safety, and it signals a committed stance against drug-related offenses in Fiji.
