The High Court in Suva has scheduled a hearing regarding the strike out application from Neelraj Sharma, the former Director of Public Prosecutions. This application pertains to compensation claims of $800,244 million filed by Veronica Malani against 11 individuals linked to the investigation of an alleged bombing incident from 1987.
During the court session on Wednesday, all involved lawyers, including Sharma’s attorney Ronal Singh, appeared before Justice Usaia Ratuvili. Singh announced that they were prepared for a hearing; however, Malani’s attorney, Sitiveni Raikanikoda, required additional time to be present.
Justice Ratuvili set the hearing for December 11, allowing all parties to submit their statements before then. Raikanikoda raised concerns over the defense’s failure to adhere to proper civil procedure, noting that none of the defense lawyers submitted a statement of defense after being issued a writ of summons. Instead, they opted to file a strike out application.
Raikanikoda also questioned the representation of former Police Commissioner Rusiate Tudravu and retired Assistant Police Commissioner Biu Matavou, noting that they are the fifth and sixth defendants in the case. He asserted that, as retired government officials, they should have legal representation and submit their own responses, considering their involvement in the lawsuit. Justice Ratuvili clarified that despite their representation, the trial would proceed as scheduled.
