High Court Hearing Set for Controversial $800K Compensation Case

The High Court in Suva has scheduled a hearing to consider the strike out application filed by Neelraj Sharma, the former Director of Public Prosecutions. This application pertains to a significant compensation claim of $800,244 million brought forth by Veronica Malani against eleven individuals involved in the investigation of the 1987 bombing case.

During the session before Justice Usaia Ratuvili, all respective lawyers were present. Sharma’s attorney, Ronal Singh, indicated their readiness to proceed; however, Malani was granted additional time to ensure that her lawyer, Sitiveni Raikanikoda, could attend the court proceedings. Consequently, the hearing is set for December 11, allowing all parties to submit their cases beforehand.

In the proceedings, Mr. Raikanikoda raised concerns regarding the defense’s adherence to proper civil procedure. He pointed out that the defense lawyers failed to file statements of defense after receiving the writ of summons, opting instead to submit a strike out application directly. He also questioned the representation of former acting Police Commissioner Rusiate Tudravu and retired assistant Police Commissioner Biu Matavou, the fifth and sixth defendants, who are currently represented by the Office of the Attorney-General despite being retired government employees. The court, under Justice Ratuvili, stated that the trial would proceed regardless of their presence.
