High Court Hearing Set for $800K Compensation Clash

The High Court in Suva has scheduled a hearing regarding a strike out application submitted by Neelraj Sharma, the former Director of Public Prosecutions. This application pertains to an $800,244 compensation claim made by Veronica Malani against 11 individuals involved in the 2020 investigation of the alleged 1987 bombing case.

During the court session on Wednesday, all legal representatives attended, and Sharma’s attorney, Ronal Singh, indicated their readiness for a hearing date. However, Malani was given additional time to ensure her lawyer, Sitiveni Raikanikoda, could attend. Justice Usaia Ratuvili has set the hearing for December 11, where all parties will present their submissions prior to the hearing.

Additionally, Mr. Raikanikoda raised concerns about the defense’s adherence to civil procedure protocols, noting that none of the defense attorneys had filed a statement of defense following the issuance of a writ of summons. Instead, they moved directly to filing a strike out application. He also questioned the legal representation of Rusiate Tudravu, the former acting Police Commissioner, and Biu Matavou, a retired Assistant Police Commissioner, who are the fifth and sixth defendants in the case. Although they are retired government officials represented by the Office of the Attorney-General, Raikanikoda asked whether they should also obtain legal representation due to their inclusion in the lawsuit. Justice Ratuvili responded that the trial will proceed regardless of their appearance at this stage.

This case highlights the ongoing legal complexities stemming from historical events, reflecting both the challenges and processes of the judicial system in addressing grievances that emerge over time. The scheduled hearing date could pave the way for a resolution and potentially contribute to the clarification of legal responsibilities for those involved in the past investigation.
