High Court Hearing Set Amid $800k Compensation Claims in Bombing Case

The High Court in Suva has scheduled a hearing to address a motion from former Director of Public Prosecutions Neelraj Sharma. This motion pertains to compensation claims totaling $800,244 made by Veronica Malani against 11 individuals linked to the investigation of the 1987 bombing case, which was brought to light in 2020.

During a court session on Wednesday, all involved lawyers were present before Justice Usaia Ratuvili. Sharma’s attorney, Ronal Singh, indicated that they were prepared to set a hearing date. However, Malani was granted additional time to ensure her lawyer, Sitiveni Raikanikoda, could be in court for the proceedings.

Justice Ratuvili subsequently scheduled the hearing for December 11, allowing time for all parties to submit their arguments beforehand. During the session, Raikanikoda raised concerns regarding the defense’s approach, highlighting that none of the defense attorneys had submitted a statement of defense following the issuance of the writ of summons. Instead, they proceeded directly to filing a strike-out application.

Raikanikoda also questioned the representation of former acting Police Commissioner Rusiate Tudravu and retired Assistant Police Commissioner Biu Matavou, who are named as the fifth and sixth defendants. Noting that they are both retired public employees, he asked whether they needed separate legal representation and should also submit filings, given the nature of the lawsuit against them. However, Justice Ratuvili clarified that the trial would proceed regardless of their appearance.

This case highlights the complexities involved in legal proceedings and the importance of adhering to proper protocols. As the court navigates these issues, there remains hope for clarity and justice in the ongoing legal discussions surrounding the historical bombing case.
