The High Court in Labasa has sentenced a 46-year-old foreman to six years in prison for raping his wife against her will, with a non-parole period of three years. The conviction occurred on May 9 for two counts of rape, which took place on July 14 of the previous year. Justice Lee James Burney imposed the sentence on June 6.
Court documents reveal that the man returned home intoxicated after visiting his brother, finding his wife and two teenage daughters already asleep. He attempted to wake his wife, who communicated her unwillingness to engage in sexual activity by shrugging her shoulders. Ignoring her refusals, he proceeded to assault her, and their 14-year-old daughter entered the room shortly after, having heard the disturbance.
During the trial, it was noted that the defendant had no previous convictions and was regarded positively within his community and workplace. He has a 30-day window to appeal the sentence.
