The High Court in Suva has scheduled a hearing for the strike out application filed by former Director of Public Prosecutions, Neelraj Sharma. This application is connected to a compensation claim of $800,244 made by Veronica Malani against eleven individuals involved in the investigation of the alleged 1987 bombing case in 2020.
During the proceedings held on Wednesday, all lawyers were present before Justice Usaia Ratuvili. Sharma’s attorney, Ronal Singh, informed the court that they were prepared to proceed but requested additional time for Malani’s lawyer, Sitiveni Raikanikoda, to be present. The court has set the hearing date for December 11, with all parties required to submit their arguments beforehand.
Raikanikoda raised concerns regarding the defense’s compliance with civil procedure, noting that none submitted a statement of defense after receiving the writ of summons and instead opted to file a strike out application directly. He also questioned the representation of retired officials Rusiate Tudravu and Biu Matavou, who are among the defendants in the case. While he pointed out they are retired government workers, they were represented by the Office of the Attorney-General. Justice Ratuvili stated that the trial would continue regardless of their appearance.
