Justice Dane Tuiqereqere has denied Apisai Madigibuli’s fourth bail application, emphasizing that without a significant change in circumstances, the chances of granting bail remain extremely low. Mr. Madigibuli is charged with the brutal murder of his pregnant wife, Kitiana Baravilala, which took place on April 25 of last year.
In his application for bail, Mr. Madigibuli raised concerns regarding potential health risks, including fears of being infected with HIV and the inhalation of harmful gases from nearby industrial facilities. He specifically mentioned the risk of contracting HIV from sharing shaving blades with other inmates.
However, Justice Tuiqereqere determined that Mr. Madigibuli failed to present evidence to support his health claims, leading to the refusal of the bail request. Consequently, Mr. Madigibuli will remain in custody pending further proceedings, with the case set to be revisited on December 23.
