The Fiji Labour Party (FLP) is contesting the validity of the Fiji Independent Commission Against Corruption’s (FICAC) decision to exonerate Deputy Prime Minister and Minister of Finance, Professor Biman Prasad, from allegations related to breaches of the Political Parties Act. The FLP has raised concerns regarding the timing and appropriateness of this announcement, particularly as it coincides with an ongoing Commission of Inquiry (COI) investigating the appointment of FICAC Commissioner Barbara Malimali.

FLP leader Mahendra Chaudhry criticized FICAC for making the statement before the COI’s findings are released, asserting that it undermines the credibility of the commission. He pointed out that the case against Prof Prasad was expected to be charged shortly after Malimali took her role, raising issues about the decision-making authority within FICAC at a time when its leadership is under scrutiny.

Chaudhry has also stressed that the legitimacy of the FICAC’s decision is questionable since it was issued by an official who has been on leave pending the inquiry’s outcome. He affirmed that the Fijian public deserves clarity on whether the decision to clear a senior Coalition member was made by a duly empowered officer or reflects internal disorganization within FICAC.

Moreover, the FLP expressed alarm that such significant developments occurred while Prime Minister Sitiveni Rabuka was abroad, suggesting that it raises institutional integrity concerns.

This claim follows previous criticisms from the FLP about the leadership of Malimali, who has faced allegations herself, and suggestions that the timing of her appointment was problematic regarding the ongoing investigations into Professor Prasad and other government officials.
