Two traders have been fined $25,000 each by the Nausori and Nadi Magistrates Court for making false and misleading claims. The Fijian Competition and Consumer Commission (FCCC) praised these rulings as part of its ongoing commitment to consumer protection.

In Nausori, a welding business was penalized for deceptive assertions regarding the quality standards of stainless-steel railings that were supplied and installed at a consumer’s home. Despite guarantees that the products met specific standards, they failed to do so, leading to dissatisfaction and financial loss for the consumer. Similarly, the Nadi Magistrates’ Court imposed a fine on another trader for misleading representations regarding vehicle warranty coverage, where it was found that the trader falsely claimed warranty protections that didn’t exist.

Senikavika Jiuta, the Chief Executive Officer of the FCCC, reiterated their zero-tolerance policy for unethical business practices, emphasizing the importance of quality and accuracy in consumer representations. She stated that the rulings serve as a firm reminder that misleading consumers in Fiji carries significant legal ramifications. The FCCC encourages consumers to report any misleading or deceptive practices they encounter.

This is not an isolated incident, as earlier in the year, the FCCC had already taken action against traders violating the Competition and Consumer Council Act 2010 for unfair pricing practices and lack of transparency. Through consistent enforcement actions and monitoring, the FCCC strives to enhance trust and transparency in trade relations, ultimately protecting consumers and fostering a healthier marketplace.

The recent court decisions reflect a collective effort to safeguard consumer rights and ensure accountability in business practices. By promoting vigilance among consumers and imposing penalties on dishonest traders, the FCCC is working to create a fairer environment for all.
