Fiji’s Overcrowded Prisons: A Call for Reform and Change

The Fiji Corrections Service (FCS) is facing a critical challenge with overcrowding in their facilities, especially the Suva Remand Centre, which is designed to accommodate only 200 remandees yet is currently housing between 380 to 400 inmates. Commissioner Dr. Jalesi Nakarawa acknowledged that such conditions not only exceed the facility’s capacity but also compromise the safety and living conditions of both inmates and correctional staff.

In light of these overwhelming numbers, Dr. Nakarawa has proposed to the Courts the need to reconsider sending individuals to remand facilities to help alleviate the critical overcrowding situation. The FCS is advocating for judicial reforms and exploring alternatives, including possible adjustments to bail conditions to reduce the number of new remandees entering the centers.

Additionally, the FCS is working to amend the existing Crisis Act, which currently holds that non-parole periods take precedence over the concept of remission. Dr. Nakarawa has expressed concern that this legal framework hinders the ability of the FCS to implement remission—typically a reduction of one-third of an inmate’s sentence based on good behavior—effectively limiting the potential for timely inmate releases. Previously, a Supreme Court ruling mandated changes to the Crisis Act, which has since complicated the remission process.

Highlighting the urgency of these legal amendments, Dr. Nakarawa noted, “The non-parole sentence disrupts our mechanism of remission… we normally deduct one-third of the sentence as remission, and that’s quite a lot.” He underscored the need to address these legislative barriers to facilitate better management of inmate populations and uphold humane conditions within correctional institutions.

While the current scenario appears dire, the ongoing discussions and efforts for reform signal a hopeful path towards improving the correctional system in Fiji. Through cooperation among the Ministry of Justice, the FCS, and community stakeholders, there is potential for a more balanced and supportive environment for remandees, ensuring fair treatment and opportunities for rehabilitation.
