The chairperson of the Fiji Human Rights and Anti-Discrimination Commission (FHRADC), Pravesh Sharma, has emphasized that it is illegal for Fijian companies to retain the passports of migrant workers. He reported a concerning rise in complaints from these workers, highlighting instances where individuals have found themselves abandoned when disputes arise between employers and employees.

In an interview with The Fiji Times’ online platform, The Lens@177, Sharma articulated the obligations of local employers who recruit migrant workers, noting that both the 2013 Constitution and various international conventions protect these workers and their families in Fiji. He pointed out that when conflicts occur, some employers leave workers without support, sometimes even leaving them homeless.

Sharma revealed that a troubling trend has emerged where local companies confiscate the passports of migrant workers. He stressed the importance of keeping passports with their rightful owners, explaining that withholding a passport serves as a means of control, preventing workers from leaving the country or seeking employment elsewhere.

The issues facing these migrant workers, according to Sharma, often include inadequate housing, unpaid salaries, and poor living conditions. However, he noted that his commission actively addresses these complaints and has a record of resolving many of them. He also reminded the public that many migrant workers send money back home, which is vital for their families.

This situation presents an opportunity for reform and a call for improved practices within local businesses, where adherence to workers’ rights can foster a healthier workforce. The hope is that awareness and action will lead to a more equitable work environment for all, ultimately benefiting both employers and employees.
