Fiji’s Legal Profession: A Crisis of Professionalism?

The Fiji Law Society has highlighted a troubling trend concerning the dwindling professionalism within Fiji’s legal community, as reported by The Fiji Times. During an Attorney-General’s conference attended by approximately 100 lawyers, society president Graham Leung shared his concerns about the current state of the legal profession amidst significant social and political shifts.

Leung expressed that legal professionals are facing a concerning level of scrutiny. He noted an alarming number of lawyers have not been meeting their responsibilities towards the courts and the general public, stating, “Generally, excellence is lacking and mediocrity the norm.” He pointed to a decline in standards across various facets of national life and indicated that the volume of complaints lodged against lawyers is indicative of deeper issues within the profession.

Since 1998, more than half of the complaints filed with the society, approximately 56 percent, relate to unprofessional conduct. Additionally, delays in legal processes accounted for 24 percent of the complaints, with other issues including disputes over fees and violations regarding trust accounts.

Leung emphasized that some legal practitioners have blurred the lines between providing unbiased legal counsel and engaging in unlawful activities under the guise of political advocacy. He noted that recent instances of lawlessness in Fiji have fostered a mindset among certain lawyers that they exist outside the boundaries of the law.

He urged members of the legal profession to engage in self-reflection to better understand the responsibilities that come with their roles.
