The ongoing developments surrounding the Commission of Inquiry (COI) have raised concerns regarding the actions of Fiji Independent Commission Against Corruption (FICAC) Commissioner Barbara Malimali. Senior counsel for the COI, Janet Mason, expressed that the Commission is “not exactly happy” with Malimali’s decision to take leave, preferring instead a suspension to prevent any potential interference with witnesses.

The request for her leave was confirmed by the Judicial Services Commission (JSC), led by Chief Justice Salesi Temo. According to Mason, while the leave means Malimali is not present in the office, it does not provide the complete assurances that a suspension would offer regarding witness testimonies. Mason conveyed frustration regarding the delays encountered in addressing these matters, stating, “It’s been disappointing in terms of how long a simple thing can take…”

Mason also emphasized the importance of access to evidence for FICAC witnesses contributing to the inquiry, seeking guarantees that their evidence would not be altered or lead to adverse employment repercussions. The COI has been adamant about maintaining the integrity of the process, particularly given Malimali’s past actions, such as her controversial termination of key witness Kuliniasi Saumi.

The inquiry is scrutinizing allegations regarding Malimali’s conduct during her past role as Chairperson of the Electoral Commission and her current leadership at FICAC. With Lisiate Fotofili stepping in as acting deputy commissioner, the JSC highlights its commitment to good governance and transparency.
