The Fiji Court of Appeal has agreed to hear the appeal for bail from former Police Commissioner Sitiveni Qiliho, who is currently serving a one-year sentence. Qiliho appeared before Justice Chandana Prematilaka at the Veiuto Court Complex in the company of former Prime Minister Bainimarama, who was released early last month.
Both men were convicted by the High Court in Suva on March 14 of this year. During the proceedings, their lawyer, Devanesh Sharma, announced that they would be withdrawing an earlier motion concerning their conviction and sentencing, which had been filed in April of the previous year. Sharma indicated that this motion was related to a previous application to stay the sentencing pending the appeal process. He expressed optimism about Qiliho’s case, especially since Bainimarama had already secured an early release.
Justice Prematilaka has allowed the applicants 21 days to submit their case for bail pending appeal. The State will have until January 21 to respond, followed by a reply from Sharma due by January 28. The next court mention is scheduled for January 30.
This legal process highlights the ongoing efforts by high-profile figures in Fiji to seek justice through the judiciary. The decisions made in this case could have significant implications for them, and perhaps set a precedent for similar appeals in the future. It remains to be seen how the court will rule, but the legal framework is in place for a thorough examination of the issues at hand.
Overall, the situation indicates a continuing evolution within the Fijian legal landscape, providing hope for individuals seeking recourse within the judicial system. As these proceedings unfold, it is crucial to ensure that justice is served fairly and transparently, reinforcing the integrity of Fiji’s legal framework.
