Fiji’s FICAC Controversy: A Pivotal Investigation Ahead

Police investigations into the ongoing case involving FICAC Commissioner Barbara Malimali will play a crucial role in the upcoming Commission of Inquiry. This unresolved situation poses significant challenges, as its resolution could impact the future leadership of Fiji’s primary anti-corruption agency.

As the police proceed with the investigation into Ms. Malimali’s alleged abuse of office, Prime Minister Sitiveni Rabuka is assessing the Commission of Inquiries Act to inform his recommendations on continuing with the inquiry. His decision is vital, especially given the rising public concerns regarding the operations of FICAC and the integrity of key national institutions.

Acting Commissioner of Police Juki Fong Chew affirmed that the results of their investigation will be influential in shaping the Commission of Inquiry. He expressed commitment to due diligence, stating they would share their findings once the investigation concludes, emphasizing adherence to proper protocol.

Previously, the Office of the Director of Public Prosecutions (ODPP) had referred Ms. Malimali’s case to the Criminal Investigation Department (CID) after a review by Deputy Director John Rabuku and Acting DPP Nancy Tikoisuva. A key factor in the ongoing investigation’s incompleteness is the absence of an interview with Ms. Malimali.

The allegations against Ms. Malimali, which focus on her role as chairperson of the Electoral Commission of Fiji, raise serious questions about possible misconduct at high levels of public service. Additionally, FICAC has faced criticism over supposed interference from senior government figures and judicial members, amplifying demands for a thorough investigation.

Political analysts have expressed concern regarding the Government’s slow response to these issues, cautioning that it could further diminish public trust in Fiji’s institutions. Prime Minister Rabuka has acknowledged that the FICAC situation has already damaged public confidence. He has assured citizens of his Government’s dedication to transparency and accountability during the inquiry process, urging patience as the framework for the Commission of Inquiry is established, with specific terms and appointments still in development. However, he indicated that these matters will be addressed adequately over time.
