The Fijian government has recently submitted a comprehensive six-volume summary detailing the nation’s constitutional history to the Supreme Court. This step follows a directive from Chief Justice Salesi Temo, who ordered the documentation to aid in ongoing proceedings concerning the validity and interpretation of the 2013 Constitution.
During a court session, Deputy Solicitor-General Eliesa Tuiloma conveyed that the State has amended both the reference and original motion as directed by the court. This extensive submission includes a “Statement of Constitutional Facts” and a tabulated appendix that collectively spans six volumes. The documents have been shared with all intervening parties, which encompass various political parties, the Fiji Law Society, and representatives from the State.
The statement underlines the distinct processes involved in the formulation of Fiji’s successive constitutions—dating back to 1970, 1990, 1997, and 2008. Furthermore, it provides insights into the amendment procedures applied to each constitution, an overview of the legislative structure, and the electoral processes implemented throughout those eras. Tuiloma also noted that the State included an overview of general elections and voter participation, although the data concludes at the 2018 election due to the unavailability of earlier election information.
