Fiji’s Bold Steps Towards AI User Protection

Fiji currently lacks specific legislation for the protection of personal data, as indicated in the report “The State of Artificial Intelligence in the Pacific Islands,” released by the AI Asia Pacific Institute based in Singapore. However, the report highlights that Fiji’s Constitution, under Clause 24, recognizes the right to personal privacy, including the confidentiality of personal information.

The report also notes that various sector-specific laws address the unauthorized disclosure of personal or client information. These include the Banking Act of 1995, the Fiji Revenue and Customs Service Act of 1998, the Medical and Dental Practitioner Act of 2010, the Rules of Professional Conduct and Practice under the Legal Practitioners Act of 2009, and the Cybercrime Act of 2021.

In March 2024, Fiji’s Deputy Prime Minister and Minister for Communications announced plans to create a framework that will protect internet users from threats posed by artificial intelligence. This initiative is part of a broader cybersecurity strategy aimed at incorporating AI governance to bolster national security.

While Fiji plans to develop this framework utilizing its own technological resources, the government will seek assistance from other nations if necessary. Furthermore, in December 2023, the Fiji Government’s Cabinet approved the creation of a National Digital Strategy. This strategy aims to provide a coordinated approach to leveraging digital technology to promote economic growth and sustainable development.
