Fiji’s Bold Step Towards Healing: Truth and Reconciliation Commission Bill 2024 Unveiled

Prime Minister Sitiveni Rabuka introduced the Truth and Reconciliation Commission Bill 2024 in Parliament on Thursday. This marked the first reading of the motion, which was seconded by Deputy Prime Minister and Minister for Finance Professor Biman Prasad.

Following the guidelines of Standing Orders 84(1), the Bill has been officially read for the first time. It will be added to the Order Paper for a second reading at a later date. Until then, Speaker Ratu Naiqama Lalabalavu has stated that the Prime Minister will announce when the second reading will occur. He encouraged Members of Parliament to take the time to review the Bill in preparation for a debate focused on its principles and benefits.

The Fiji Truth and Reconciliation Commission Bill 2024 aims to create a Commission that fosters open dialogue. It intends to offer a platform for addressing historical grievances while promoting national unity and reconciliation throughout Fiji.

The Bill includes several clauses, beginning with Clause 1, which outlines its title and commencement. If approved by Parliament, the legislation will take effect on a date specified by the Minister via a Gazette notice. Clause 2 provides definitions for terms used in the Bill, while Clause 3 details the contents of the Bill.

Clause 4 establishes that the legislation is binding on the State as it is implemented. Furthermore, Clause 5 sets up the Commission, which will consist of five members appointed by the President. Clause 6 describes the functions of the Commission, and Clause 7 defines its powers.

Additionally, Clause 21 authorizes the Minister to create regulations needed to implement and fulfill the objectives of the new law. Schedule 1 outlines the Code of Conduct for the Commission, and Schedule 2 details the oath or affirmation of office required from each Commissioner. This new legislation falls under the purview of the Minister responsible for truth and reconciliation.
