Fiji’s Bainimarama Trial Faces Postponement as Prosecution Seeks Delay

The trial of former Prime Minister Voreqe Bainimarama, former health minister Dr. Neil Sharma, and former attorney-general Aiyaz Sayed-Khaiyum may face postponement as the prosecution has requested to defer the proceedings. The defendants appeared before Justice Usaia Ratuvili at the High Court in Suva for a final pretrial conference. Currently, the trial is slated to take place from November 10 to 14, 17 to 21, and 24 to 28.

All three individuals are accused of violating the 2010 Procurement Regulations by failing to comply with necessary statutory requirements. Dr. Sharma is facing two counts of abuse of office and two counts of breach of trust; Sayed-Khaiyum is charged with one count of abuse of office and one count of obstructing justice, while Bainimarama faces one count of abuse of office.

The request for a trial deferral comes from Senior State Lawyer Pooja Mishra, who cited a significant amount of new material that has emerged. In response, Dr. Sharma’s attorney, Wylie Clarke, suggested rescheduling to March 2026, while Gul Fatima, representing Bainimarama and Sayed-Khaiyum, proposed a later start in 2026 due to scheduling conflicts.

The case, marked by a backdrop of allegations related to non-adherence to procurement protocols, underscores ongoing issues of governance and public service integrity in Fiji.
