Fiji to Modernize State Lands Act for Transparent, Sustainable Land Use

A thorough review of the State Lands Act 1945 has been initiated by Acting Attorney-General Siromi Turaga, aimed at modernizing and bolstering the legal framework for State land management in Fiji. The Terms of Reference (TOR), released on October 9 by the Fiji Law Reform Commission, outlines how this collaborative effort between the Fiji Law Reform Commission (FLRC) and the Ministry of Lands and Mineral Resources (MLMR) will ensure that the legislation aligns with Fiji’s current development goals and international best practices.

Mr. Turaga emphasized that the review would make informed recommendations to facilitate effective implementation of the Act, addressing contemporary needs. He pointed out that the existing State Lands Act has not evolved in tandem with modern developments in land management, environmental policies, and socio-economic conditions. Over time, new challenges concerning land use, environmental stewardship, and equitable access have arisen, necessitating a legislative update. “This review will help ensure our laws are modern, transparent, and sustainable,” stated Mr. Turaga.

Key objectives of the review include enhancing transparency and accountability in the allocation and management of State lands, ensuring equitable access, promoting sustainable land use practices, and rectifying outdated provisions. Additionally, the review will examine how the State Lands Act connects with other critical legislation such as the Land Transfer Act 1971, Property Law Act 1971, Agricultural Landlord and Tenant Act 1966, Environment Management Act 2005, and Climate Change Act 2021.

Mr. Turaga further indicated the Government’s interest in ensuring the framework is not only practical but also inclusive. The review process will also incorporate consultations with various stakeholders, including government entities, traditional authorities, landowners, civil society groups, and the private sector.

The comprehensive review will be overseen jointly by the Permanent Secretary for Lands and Mineral Resources and the Director of the Fiji Law Reform Commission, with the final report, including a draft revised State Lands Bill and relevant regulations, expected to be submitted to the Acting Attorney-General and the Minister for Lands and Mineral Resources by January 30, 2026.

This endeavor reflects the government’s commitment to transparency, equity, and sustainable land management, aiming to ensure State land laws serve the best interests of the Fijian people for generations to come. The proactive steps being taken underscore a vision for a future where land management contributes to economic growth and community welfare, highlighting the potential benefits for local communities and stakeholders in Fiji’s land and resource management landscape.
