The Supreme Court of Fiji has imposed a revised financial penalty on Suresh Chandra, the former Chairman of the Electoral Commission, dividing a previously set $500,000 fine into a $100,000 fine and a $400,000 compensation payout for clients affected by mishandling within his law firm, M C Lawyers. This decision was delivered by Justice Brian Keith on April 30.

Chandra faced serious professional misconduct charges, with a commission determining that he failed to adequately supervise the management of the trust account, a situation deemed severe enough to justify the sanctions. The commission’s findings cited Chandra’s reluctance to accept responsibility, often trying to shift blame, which ultimately led to his disbarment.

An earlier ruling by the Fiji Court of Appeal had confirmed the appropriateness of the actions taken against Chandra, indicating that his violations were not isolated incidents, but rather indicative of ongoing negligence which severely impacted clients who lost money due to the mismanagement of trust accounts.

Justice Keith acknowledged the commission’s assessment and decided that while Chandra would bear a financial penalty, the majority of the funds would be directed to compensate the affected clients, highlighting a commitment to restitution and justice for those who suffered losses.
