The Fijian government has initiated a comprehensive review of the country’s human trafficking laws, entrusting the Fiji Law Reform Commission with the task of developing an updated and forward-looking legal framework to combat all forms of trafficking. This significant move was formally initiated by Acting Attorney-General Siromi Turaga, in accordance with the Fiji Law Reform Commission Act of 1979.

The review comes in light of Fiji’s ongoing classification on the Tier 2 Watch List in the United States State Department’s annual Trafficking in Persons (TIP) Report, which highlights existing deficiencies in the prevention, protection, and prosecution efforts against human trafficking in the country. The Commission is tasked with performing a thorough gap analysis of existing legislation, specifically examining the Crimes Act 2009, Immigration Act 2003, and Cybercrime Act 2021. It will evaluate whether the definitions, penalties, and protective measures within these laws align with international standards.

In conducting the review, the Commission will assess how various factors—such as poverty, migration, gender inequality, and lack of public awareness—contribute to vulnerabilities associated with trafficking. To ensure a comprehensive approach, public consultations will be organized, engaging government agencies, civil society organizations, legal experts, academia, and international partners. Additionally, the Commission will analyze local data and examine inter-agency coordination mechanisms.

A final report detailing recommendations and proposed legislative amendments or a draft Bill, accompanied by a Cabinet Paper, is expected to be submitted to the Acting Attorney-General by September 30, 2026. This proactive approach reflects Fiji’s commitment to improving its legal framework and enhancing protections against human trafficking, aiming to ultimately elevate its standing in international assessments and safeguards for vulnerable populations.
