Fiji Referendum Bill 2025 Triggers Free Speech Outcry

Nilesh Lal, the executive director of Dialogue Fiji, has issued a strong condemnation of the recently proposed Referendum Bill 2025, stating that it poses a significant threat to free speech and democratic engagement in the country. In a social media statement, Lal described the legislation as potentially the most severe infringement on public discourse seen in Fiji’s history.

Lal pointed out that the bill includes stringent restrictions on public discussions, campaigning, and civic involvement surrounding referendums, suggesting that it would effectively criminalize nearly all forms of public debate regarding referendum topics. He remarked, “This is about as undemocratic as it gets,” emphasizing that the constraints are more severe than those previously enacted by the FijiFirst government.

One of the most alarming aspects of the bill, according to Lal, is a clause that bans any expressions related to referendums at any time—before, during, or after the voting process. He termed this provision a “blanket permanent criminalization of expression,” which he believes undermines the ability for open dialogue and civic education, key components for a legitimate referendum.

Lal stressed that a referendum’s legitimacy hinges on citizens’ access to diverse viewpoints, the opportunity to engage in discussions, and the facilitation of civic education. He noted that the current proposed framework inhibits these essential democratic elements, framing it as a move towards a state-controlled and biased electoral process.

If the Referendum Bill 2025 is adopted in its existing form, Lal warned that it would represent a serious regression in Fiji’s democratic evolution, marking a troubling trend for the nation’s commitment to democratic principles and public participation. He has called for a reconsideration of the bill, urging that democracy thrives on the foundation of free expression and civic engagement.
