The Opposition is urging the Prime Minister to reevaluate the legal advisors he has been relying on, especially given that their advice has faced repeated legal challenges. In a statement from Opposition Leader Inia Seruiratu, concern was expressed about recent efforts toward an out-of-court settlement, which he believes reflect weak leadership and diminished confidence in previously endorsed findings by the Prime Minister.

Seruiratu highlighted alarming reports indicating that the Judicial Services Commission, alongside the Office of the Attorney-General, is engaged in discussions aimed at settling issues raised by the Commission of Inquiry into the appointment of the FICAC Commissioner. He emphasized that this inquiry was established and funded by the government, under its own authority.

According to Seruiratu, the Attorney-General, who serves as the government’s principal legal advisor, plays a critical role in guiding the legality and constitutional implications of government actions. He pointed out that the Judicial Services Commission’s decision to seek judicial review, coupled with the government’s apparent willingness to settle rather than uphold the inquiry’s findings in court, calls into question the overall quality of legal advice provided to the Prime Minister and his cabinet.

Additionally, he asserted that these developments may indicate a failure to adequately assess constitutional risks prior to initiating the inquiry. This poor legal guidance raises doubts about the interpretation of both the Constitution and the FICAC Act.

The Opposition Leader warned of unnecessary public expenditure, stating that any settlement that nullifies or diminishes the inquiry’s findings might lead to public funds being spent on processes that do not pass “basic constitutional scrutiny.” He asserted that good governance requires competence, accountability, and responsible management of public resources, and he believes Fiji deserves nothing less.

This situation emphasizes the importance of sound legal advice in governance and raises significant questions about accountability and the responsible use of taxpayer money.
