The Fiji Law Society has advised Janet Mason, counsel assisting the Commission of Inquiry (COI) into the appointment of Barbara Malimali as Commissioner of the Fiji Independent Commission Against Corruption (FICAC), to step aside due to concerns that her ongoing involvement could undermine public confidence in the inquiry. The Society has clarified that while it does not advocate for her outright removal, it believes her stepping aside is prudent until the allegations regarding her professional conduct are resolved.

This recommendation follows a finding of misconduct against Mason by the New Zealand Lawyers and Conveyancers Disciplinary Tribunal, a decision she is currently appealing. Additionally, serious allegations have surfaced concerning her application for a Fiji practicing certificate, which have raised concerns regarding the handling of her case by the Legal Practitioners Unit.

The Society emphasized the necessity of maintaining high standards of integrity and professionalism among all participants in the COI, especially since the inquiry is scrutinizing the legality and appropriateness of Malimali’s appointment. Both Mason and the Commissioner must possess integrity beyond reproach to uphold public trust in the inquiry.

Mason has publicly expressed her grievances regarding the Fiji Law Society’s actions, alleging attempts to undermine her position, and has filed a police report relating to document tampering associated with her application for a practicing certificate. She insists on her qualifications as a legal practitioner and maintains that her involvement in the COI is vital for ensuring transparent governance practices.

The current inquiry is pivotal, as it seeks not only to clarify the specific allegations around Malimali’s appointment but also to promote a culture of accountability and ethical governance within Fiji. There is optimism that the inquiry could catalyze necessary reforms, enhancing public trust in government institutions and reinforcing the commitment to integrity within Fiji’s political landscape.

As these events unfold, they illustrate a crucial moment for accountability in Fiji’s governance structure, with the potential to restore faith in transparency and integrity in public service appointments.
