The Fiji Law Society (FLS) has formally reached out to the Chair of the Tribunal handling the case of suspended Director of Public Prosecutions, Christopher Pryde, raising concerns about the fairness and propriety of the proceedings. Wylie Clark, the President of FLS, emphasized the critical question at this juncture: can the Tribunal continue its work without the presence of Pryde or his legal counsel?

Clark pointed out that Pryde’s withdrawal from legal representation was a direct result of financial constraints stemming from the suspension of his salary. This situation raises serious concerns regarding his constitutional rights to procedural and administrative fairness under Section 16(1)(a).

The FLS has offered to assist the Tribunal in a specific capacity as amicus curiae, meaning “friend of the court.” However, they are cautious about taking on a more expansive role, especially in light of Pryde’s absence. In their proposed capacity, the Society aims to provide valuable legal insights, highlight pertinent legal arguments, and advise on the broader implications of the ongoing proceedings.

Furthermore, Clark noted that the Tribunal has reached out for guidance on the interpretation and application of the term “misbehaviour” within similar constitutional frameworks. The Society is ready to submit their findings and support the Tribunal by focusing on these critical issues.
