Fiji Law Society Raises Alarm Over DPP Allegations

The Fiji Law Society (FLS) has voiced serious concerns following a formal complaint filed by the Office of the Director of Public Prosecutions (ODPP) to the Fiji Independent Commission Against Corruption (FICAC) against the reinstated Director of Public Prosecutions, Christopher Pryde. FLS President Wylie Clarke noted that it is unusual for a governing body like the ODPP to comment on such allegations, particularly with statements attributed to Acting DPP Nancy Tikoisuva.

Clarke emphasized the critical nature of preserving an individual’s right to a fair trial, arguing that publicizing allegations can infringe upon privacy rights and disrupt judicial integrity. He highlighted the importance of confidentiality surrounding unproven allegations, stating that these rights must be upheld to maintain public trust in the justice system.

The complaint against Pryde is rooted in serious accusations, including alleged financial misconduct related to unauthorized gratuity payments and discrepancies in financial conduct during his tenure. Despite these allegations, Clarke reaffirmed that Pryde deserves the presumption of innocence as an investigation has just commenced, and no charges have been formally laid yet.

Interestingly, this complaint follows a tribunal’s earlier ruling that cleared Pryde of similar misconduct allegations, allowing his reinstatement starting January 20, 2025. The tribunal emphasized the lack of sufficient evidence to support earlier claims against him. Furthermore, the tribunal’s findings may serve as essential legal guidelines moving forward, helping to address governance and ethical concerns within the ODPP.
