Members of the Judicial Services Commission convened this afternoon in response to a High Court ruling concerning the removal of former FICAC Commissioner Barbara Malimali. Prominent figures attending the meeting included Chief Justice Salesi Temo, Permanent Secretary for Justice Selina Kuruleca, Vani Catanasiga, and JSC Secretary and Chief Registrar Tomasi Bainivalu.
On Monday, the High Court declared that Malimali’s removal was unlawful, emphasizing that the Prime Minister lacked the legal authority to recommend the President revoke her appointment as Commissioner of the Fiji Independent Commission Against Corruption. Justice Dane Tuiqereqere highlighted the importance of the Judicial Services Commission, stating that it is the only body constitutionally mandated to advise the President in such situations.
Justice Tuiqereqere further indicated that any claims regarding damages or reinstatement would be a matter for the JSC to resolve.
