The High Court has scheduled a three-day hearing from April 10 to April 12 this year to address a civil case involving four individuals who are contesting the findings of a contentious Commission of Inquiry report. The applicants are Barbara Malimali, a former commissioner of the Fiji Independent Commission Against Corruption (FICAC), Fiji Law Society President William Wylie Clarke, immediate past president Laurel Vaurasi, and former attorney-general Graham Leung.

These parties are seeking a judicial order to invalidate both the findings and the recommendations outlined in the report. The respondent in this case is the Commission of Inquiry concerning Malimali’s appointment as FICAC commissioner, along with other associated parties.

Justice Dane Tuiqereqere has instructed the Attorney General’s office to investigate the transcripts from the Commission of Inquiry hearing and ensure they are available to the court and all involved parties. Justice Tuiqereqere emphasized that these transcripts are crucial for evaluating the evidence that led to the findings of the Commission of Inquiry.

The proceedings have been adjourned until next Monday, when confirmation regarding the availability of the transcripts will take place. This legal challenge reflects ongoing concerns regarding transparency and accountability within the commission’s processes, highlighting the robust legal avenues available to those questioning governmental decisions.
