The High Court is set to announce its ruling on Monday regarding President Ratu Naiqama Lalabalavu’s authority to terminate Barbara Malimali’s appointment as the Commissioner of the Fiji Independent Commission Against Corruption (FICAC) based on the advice of Prime Minister Sitiveni Rabuka.

This significant case was brought before Justice Dane Tuiqereqere, who reassured the parties involved that the ruling would be delivered as scheduled, expressing regret for previous delays that had necessitated adjournments. Justice Tuiqereqere conveyed that he is nearing the conclusion of his ruling after thoroughly reviewing the extensive Commission of Inquiry (COI) report.

During a prior hearing last year, it was argued that Prime Minister Rabuka lacked the authority to recommend the revocation of Malimali’s appointment. In addition to this pivotal ruling, Justice Tuiqereqere will also address an application for judicial review concerning four individuals implicated in the contentious COI report. These individuals include Barbara Malimali, Fiji Law Society President William Wylie Clarke, former president Laurel Vaurasi, and ex-attorney-general Graham Leung, all challenging the report’s findings and recommendations.
