The Fijian Competition and Consumer Commission (FCCC) has issued a stern warning to maritime operators, vessel owners, agents, and port-based businesses against obstructing its officers in their duties. The Commission emphasized that preventing authorized FCCC officers from performing their legal responsibilities is unlawful and unacceptable. This directive aims to protect passengers from unethical practices, such as overcharging and inadequate treatment.

As maritime travel is expected to surge during the festive season, the FCCC has actively deployed its officers at major wharves and ports in both the Central and Northern Divisions of Fiji. In a notable first, the Commission has initiated shift-based enforcement operations at these locations, with officers working extended hours to ensure thorough oversight during peak travel times.

According to the FCCC (Control of Maritime Shipping Services, Freight Rates and Passenger Fares) Order 2022, the Commission is legally responsible for fixing, monitoring, and enforcing the prices of all maritime shipping services, freight rates, and passenger fares within Fiji. This regulation also empowers FCCC officers to board vessels to ensure compliance with these rules.

Section 126 of the FCCC Act grants authorized officers the authority to enter premises, including ports, vessels, and offices during reasonable hours to gather information and verify compliance. Additionally, Section 128 of the Act specifies that interfering with an FCCC officer is a criminal offense. The Commission reiterated that any attempts to obstruct their work will be addressed legally, potentially leading to statements being taken and charges being filed.

Throughout the festive season, the FCCC will closely monitor passenger fares, freight charges, price displays, and operator conduct towards its officers to ensure compliance and protect consumers. Passengers who experience incidents of overcharging or unfair treatment are encouraged to report these occurrences to the FCCC promptly, reinforcing the Commission’s commitment to consumer protection in Fiji’s maritime sector.

This proactive approach underscores the FCCC’s dedication to safeguarding the interests of passengers, particularly during busy travel periods, showcasing an effort to maintain fairness and transparency in the maritime industry.
