The Judicial Services Commission (JSC) has initiated legal action by filing for judicial review against the findings and recommendations of the Commission of Inquiry (COI) report concerning the appointment of the Fiji Independent Commission Against Corruption (FICAC) Commissioner. The report, dated May 1 and received by the JSC on June 17, is criticized for its interpretation of the FICAC Act and the constitution, which the JSC believes could potentially trigger a constitutional crisis if not addressed.

The JSC disputes the COI’s interpretation regarding the procedures and powers related to the FICAC Commissioner’s appointment, suggesting that the findings are inconsistent with the evidence. Concerns have also been raised about the report’s public release and subsequent use against JSC officers, which the commission finds lacks merit.

The legal team representing the JSC has labeled the COI’s conclusions as flawed and insists that the COI’s findings misinterpret crucial legal provisions, specifically referencing sections of the 2013 Constitution and the FICAC Act of 2007. The JSC warns that these misinterpretations could undermine its role and responsibilities and is seeking to annul the COI’s findings via an Order of Certiorari as part of the judicial review process.

Since the COI report became public, its findings have fueled political discourse and been used against JSC officials, which the commission describes as unfortunate. The JSC has cautioned that further legal action may be taken against those misusing the report. Notices pertaining to the judicial review will soon be issued to relevant parties involved.

This legal move highlights ongoing tensions surrounding governance and the interpretation of constitutional and legal mandates in Fiji.
