The Fijian Government has decided not to appeal the recent ruling concerning former FICAC Commissioner Barbara Malimali. This conclusion was reached after careful consideration and extensive legal consultation, including discussions with the President.

In an official statement, the government expressed its respect for the High Court’s decision in the case of HBJ 5/2025 Barbara Malimali v. The President of Fiji and Others. The government appreciated the Judiciary for its thoughtful and independent consideration of the case.

The ruling, which was reviewed based on advice from a distinguished King’s Counsel, has been acknowledged by the government as a pillar of justice and fairness for all citizens. The statement highlighted that the decision reinforces the integrity of Fiji’s legal system, emphasizing the importance of the separation of powers and the necessity of independent judicial decisions free from political influence.

The Government reiterated its commitment to upholding the rule of law and constitutional processes, respecting the Judicial Services Commission’s authority in reaching a final resolution regarding Malimali’s case.

Prime Minister Sitiveni Rabuka affirmed the government’s dedication to democratic principles, governance, accountability, and the autonomy of the judiciary. Reflecting on this development, Malimali’s attorney, Tanya Wakanika, expressed gratitude on social media, acknowledging the support of the Fijian government and divine intervention.
