A tribunal established under Fiji’s Constitution has determined that the Director of Public Prosecutions (DPP), Mr. Christopher Pryde, is not guilty of any alleged misconduct, and there are no grounds for his removal from office. The tribunal, led by Justice Anare Tuilevuka and supported by Justices Chaitanya Lakshman and Samuela Qica, submitted its findings to President Ratu Naiqama Lalabalavu on December 23, 2024. Following a thorough review, the President accepted the tribunal’s unanimous decision.

Key findings from the report include a complete lack of evidence for the allegations against Mr. Pryde. Additionally, the tribunal’s conclusions help clarify the ambiguous term “misbehaviour,” which is not defined in the nation’s Constitution. They have also advised the Judicial Services Commission (JSC) to create clearer policies and processes to manage complaints about judicial and quasi-judicial officers, aiming for increased consistency, transparency, and accountability.

Regarding Mr. Pryde’s resumption of his duties, the tribunal stated that his 2019 Agreement of Service with the Government will be reinstated immediately and any overdue salary and benefits will be compensated promptly. Mr. Pryde will collaborate with the JSC to ensure a smooth transition back to his office, including the return of official equipment.

In expressing appreciation for the work done by the tribunal members, the President praised their professionalism and the valuable contributions they’ve made to Fiji’s legal system. The tribunal’s full report is now accessible to the public.

This ruling not only reinforces the integrity of the judicial system in Fiji but also sets a precedent regarding the definition and interpretation of “misbehaviour” in the legal context, paving the way for clearer standards moving forward. The outcome signifies a commitment to upholding justice and accountability within the country’s legal framework.

Overall, the situation demonstrates the effectiveness of judiciary oversight and the importance of maintaining high ethical standards in public offices, fostering hope for continued impartiality and fairness in Fiji’s legal proceedings.
