Fiji Defends 15-Year Talks Over Employment Relations Bill 2025

The Transport Commerce & General Workers Union has strongly defended the consultation processes associated with the Employment Relations (Amendment) Bill 2025, countering claims of inadequate engagement as “misleading and unfair.” In a submission to the Parliamentary Standing Committee, General Secretary Kamlesh Kumar emphasized that the tripartite consultations—comprising the government, employers, and unions—have been ongoing for over 15 years, asserting that if this duration is deemed insufficient, there will never be adequate time for meaningful discussions.

Kumar pointed out that the Fiji Commerce and Employers Federation (FCEF) has acknowledged its involvement in these consultations, which have included significant negotiations facilitated by the Employment Relations Advisory Board (ERAB) over the past three years. Notably, he stated that FCEF representatives have been part of these discussions, during which they had substantial influence under previous government regimes.

Responding to criticisms regarding the efficacy of the consultation process, Kumar highlighted its thoroughness and inclusiveness. He noted that more than 80 percent of the issues raised have been agreed upon through extensive consultations, many of which extended late into the night. He explained that only unresolved matters were left for the government’s decision.

At a nationwide roadshow organized by the Ministry of Employment, Kumar recounted his experience at a consultation in Nadi attended by numerous employer representatives, none of whom contributed orally to the discussions, while union leaders voiced their submissions. He also addressed worries regarding fines included in the proposed amendments, clarifying that penalties had been notably reduced during consultations. Kumar emphasized that fines serve as deterrents rather than punishments, assuring that law-abiding employers should have no concerns.

The Employment Relations (Amendment) Bill 2025 is currently under evaluation in Parliament, with diverse stakeholder inputs being considered. The government’s proactive approach in terms of consultation reflects a commitment to fostering a balanced legislative framework that engages both employers and employees while aiming to enhance workplace relations across Fiji.
