The application made by Zarin Khan’s legal team to lift the Stop Departure Order imposed by the Fiji Independent Commission Against Corruption (FICAC) has been denied by Resident Magistrate Semi Babitu. Khan, affiliated with Aliz Pacific, requested permission to travel overseas for medical reasons through his legal representation from the firm Lal, Patel and Bale.
FICAC’s Principal State Counsel, Lilian Mausio, opposed the application, asserting that the court lacked the jurisdiction to consider the matter and that Khan’s request was misconstrued. Mausio pointed out that since Khan has not faced any charges, the relevant provisions of the Criminal Procedure Act do not apply in this situation.
In his ruling, Magistrate Babitu reaffirmed that the court does not have the authority to intervene, as the Stop Departure Order was legitimately issued by the Commissioner of FICAC, who acted within her rights according to the FICAC Act.
This ruling emphasizes the importance of due process and the legal frameworks governing anti-corruption measures in Fiji. While it may be difficult for Khan at this moment, it serves as a reminder of the judicial system’s checks and balances. Hope remains that Khan can address his medical needs in the future as circumstances evolve.
