The Suva High Court has granted permission for the State’s amended information in the Health Ministry tender case involving former Prime Minister Voreqe Bainimarama, former Attorney-General Aiyaz Sayed-Khaiyum, and former Health Minister Neil Sharma. The amendment specifically revises the dates associated with the alleged offences, allowing the prosecution to clarify the charges more effectively.
While defense counsels raised objections regarding the timing and adequacy of disclosure related to the amendment, the court carefully considered the legal arguments presented and ultimately decided to allow the amended information to proceed. Consequently, all three accused individuals have been excused from attending further court sessions until the next scheduled hearing.
Dr. Sharma faces multiple charges, including two counts each of abuse of office and breach of trust by a public officer. Bainimarama is accused of one count of abuse of office, whereas Sayed-Khaiyum is charged with one count of abuse of office and one count of obstructing the course of justice.
The charges stem from alleged violations of statutory requirements outlined in the 2010 Procurement Regulations during the awarding of medical equipment tenders in 2011. This case highlights the ongoing scrutiny of governmental compliance in procurement processes, which is essential for maintaining transparency and accountability in public service.
