The Fiji Council of Social Services (FCOSS) has expressed its approval of Prime Minister Sitiveni Rabuka’s decision to refrain from appealing a High Court ruling that declared the dismissal of former Fiji Independent Commission Against Corruption (FICAC) Commissioner Barbara Malimali unlawful. President Sepesa Rasili emphasized that the decision marks a prudent approach, underlining that accountability is essential for the integrity of Fiji’s democracy.

In an official statement released on Thursday, the government outlined that following legal consultations, it was collectively decided by the President and the Government not to pursue an appeal against the High Court ruling regarding Malimali. Rasili underscored that adherence to well-established legal processes is crucial and non-negotiable in upholding the nation’s legal framework. He remarked that the Prime Minister’s advisors should prioritize the rule of law and human rights, steering clear of misguided popular opinions.

The High Court’s recent ruling clarified that only the Judicial Services Commission (JSC), and not the Prime Minister, holds the authority to advise the President on the appointments and removals of FICAC Commissioners. In response, the JSC convened on Thursday and committed to collaborating with Acting Attorney-General Siromi Turaga to formulate independent recommendations regarding Malimali by March 31st.

Despite this positive step forward, Rasili expressed concerns regarding whistleblower allegations linked to the Fiji Sports Council and the Minister of Youth and Sports. He noted a growing public distrust in institutions such as FICAC and urged immediate action to reinstate this trust. He called for all individuals implicated in these allegations to step aside while a comprehensive and independent investigation is conducted into the Fiji Sports Council, the Ministry of Youth and Sports, FICAC, and the Prime Minister’s Office.

Rasili acknowledged the frustrations prevalent in society but emphasized the importance of transforming this discontent into constructive actions aimed at bolstering the nation’s integrity and governance standards. This proactive stance demonstrates a commitment to restoring public confidence in governmental institutions, paving the way for meaningful reforms in Fiji’s political and social landscape.
