Fiji Airways has expressed serious concerns over the proposed Employment Relations (Amendment) Bill, warning that it could impose severe fines, criminal liabilities, and expansive enforcement powers that threaten the sustainability of businesses and aviation operations. Anna Morris, the airline’s Chief People and Performance Officer, voiced these issues during a discussion with the Standing Committee on Economic Affairs, emphasizing the need for fair labor practices while critiquing the bill’s punitive nature.
Morris pointed out that the legislation does not sufficiently differentiate between intentional misconduct and administrative errors, which could have significant repercussions for employers. She highlighted the potential for employers to be penalized for failing to comply with a labor officer’s directive, even if that order is unreasonable or unjust. This situation, she argued, fosters an environment susceptible to arbitrary enforcement and abuses of power.
Additionally, Morris raised alarms regarding proposed changes to leave provisions and unfair dismissal tests, suggesting that these could further complicate operational efficiency within the aviation sector. Specifically, she noted that implementing Clause 96 could lead to challenges in employee scheduling, disruptions in operations, and increased costs for a large workforce like that of Fiji Airways.
Echoing these sentiments, Seni Nabou, a director on the Fiji Airways Board, warned that minor or accidental violations could be treated as equally grievous as intentional wrongdoings under the new Bill. In response to the concerns, Deputy Chair Premila Kumar affirmed her commitment to ensuring that the legislation will not follow a “one size fits all” approach, indicating a willingness to consider the unique needs of different sectors.
