The Electoral Commission (ECF) has taken a strong stance on the appointment of the Supervisor of Elections (SoE), with ECF member Dr. Atu Emberson Bain recently testifying to the Commission of Inquiry about the lack of meaningful communication from the Constitutional Officers Commission (COC). Dr. Bain revealed that the ECF sent six formal letters between August 2023 and April 2024, urging the COC to consult them regarding the appointment of the SoE, but received no response until January 2025.

In his testimony, Dr. Bain quoted that on January 4, 2025, the ECF received the COC Selection Panel Report along with a seven-day deadline for feedback. The ECF responded on January 11, describing the recruitment process as “seriously flawed and lacking credibility,” advocating for a restart of the appointment process.

Additionally, Dr. Bain indicated that Barbara Malimali, the former Chair of the Electoral Commission, was actively opposing the appointment of Ana Mataiciwa as SoE. He noted that Malimali’s proposals for consultation were legitimate and within her role’s mandate, emphasizing the ECF’s constitutional right to be involved in such decisions.

This situation is further complicated by ongoing tensions and allegations of misconduct involving Malimali, Mataiciwa, and the role of the Fiji Independent Commission Against Corruption (FICAC). Recent reports indicate that Mataiciwa has filed a police complaint against Malimali, asserting that her actions constituted intimidation and harassment amidst ongoing investigations.

The developments reflect significant challenges within Fiji’s electoral governance and raise questions about accountability and transparency. However, there is hope that the forthcoming investigations and inquiries will lead to clearer governance guidelines and improvements in the electoral processes, fostering greater public confidence in the integrity of Fiji’s electoral system. The involvement of multiple entities emphasizes the essential need for systemic reforms to uphold democratic principles within the nation’s governance structures.
