The situation surrounding the Barbara Malimali case has escalated significantly, as Ana Mataiciwa, the Supervisor of Elections (SOE), has filed a police report against the Commissioner of the Fiji Independent Commission Against Corruption (FICAC). This report, submitted on November 28, 2024, to Acting Police Commissioner Juki Fong Chew, includes serious allegations of abuse of office, intimidation, and harassment of witnesses.
The complaint is part of a larger ongoing Criminal Investigation Department (CID) inquiry focused on Ms. Malimali. Scrutiny of Ms. Malimali’s appointment is intensifying, especially with the involvement of a Commission of Inquiry. The CID is also looking into allegations of misconduct during her time as chairperson of the Electoral Commission (EC).
In confirming the report, Mr. Chew indicated that investigations are currently in progress. Ms. Mataiciwa expressed that her decision to file the report stemmed from correspondence received from both the Secretary to the Constitutional Offices Commission (COC) and the Chief Registrar’s Office earlier this month. She stated that these queries were linked to Ms. Malimali’s claims against her, suggesting that she aided in Ms. Malimali’s arrest. Furthermore, a request for her response regarding professional misconduct allegations was received from the Chief Registrar’s Office, which included input from two other legal practitioners.
Ms. Mataiciwa argued that Ms. Malimali’s behavior, particularly given her position as a crucial witness in an active investigation, constitutes intimidation and harassment. In addition, former Acting Deputy Commissioner of FICAC Francis Puleiwai has also come forth with accusations against Ms. Malimali, claiming she misused her authority to enforce a stop departure order earlier this year. Mr. Chew confirmed that this matter has also been assigned to the CID for further investigation.
Attempts to reach Ms. Malimali for comments remained unsuccessful at the time of reporting.
